Recovering Damages for Sexual Exploitation and Sexual Abuse
There are cases in which a person may be a victim of a Sexual Harassment by a Professional who is under a legal obligation of trust to protect that person. Sexual Harassment can also becalled Sexual Exploitation when it is committed by a mental health professional. Sexual Exploitation can occur between a doctor and patient or clergy and penitent even if the victim consented to having sexual relations with the predator. These cases involve relationships of trust and power, and because of that the law recognizes that patients can be tricked or coerced into romantic or sexual relationships with their doctor, priest, rabbi, therapist, or mental health counselor. These relationships include the following:
- Doctor – Patient
- Psychiatrist – Patient
- Therapist – Patient
- Social Worker – Patient
- Psychologist – Patient
- Family Counselor – Patient
- Clergy – Penitent
We also pursue cases of Sexual Exploitation and Sexual Harassment by Lawyers who sexually harass or molest their own clients.
Mr. Madison has successfully sued and obtained money recoveries against several prominent Texas doctors who had sexually molested and exploited their patients. One of these cases involved a Dallas physician, who was sexually molesting his female patients while they were under anesthesia. Mr. Madison exposed this physician as a sexual predator. After this case came to light, this doctor was convicted of Sexual Indecency, was sentenced to jail, and lost his medical license. This former doctor is now a registered sex offender.
In these situations it is not uncommon for an unscrupulous predator to exert their power and control over their patient (or client, or student) to coerce the other person to “consent” to a sexual relationship. Although the victim may have “consented” it is a consent that the law may not recognize as being legitimate and this may give rise to a civil claim for Sexual Exploitation. Situations that we commonly see are doctors, therapists, and psychiatrists coercing their patients to have sex with them under the guise that it is part of therapy or will assist them in treating the patient’s mental condition. We have handled several cases involving female patients who were molested by their ob-gyn doctor during gynecological exams. Other situations may involve unscrupulous lawyers who offer to waive their fees in return for their clients having sexual relations with them.

It is common for victims of sexual harassment, sexual abuse, sexual exploitation, and assaults, to experience depression and guilt over the abuse they suffered. It is important to remember that victims of these assaults did not ask to be abused. Predators are quite adept at manipulating and coercing patients and clients into situations that the predator knows are unethical and illegal. It takes time, counseling, and healing to transition from being a victim to a survivor. Victims of abuse usually have a long period of time of pain, guilt, depression, and recovery. Though you may physically survive the abuse and harassment, you will never forget the pain and betrayal when you are exploited and abused by your therapist, psychologist, psychiatrist, social worker, doctor, or family counselor. Most survivors of sexual exploitation suffer from long-term trauma and post-traumatic stress disorder that result from being victimized by sexual exploitation. Whether you were sexually exploited or sexually abused by an acquaintance, a trusted professional, or a stranger, you may have the right to pursue a civil action against your abuser. At The Law Offices of Kevin R. Madison, P.C. we are dedicated to helping the survivors of sexual exploitation and sexual harassment assert their legal and moral right to pursue predators and bullies. You may be entitled to seek financial compensation from the person who molested or abused you.
